北京理工大学珠海学院2020届本科生毕业论文Analyze The Confucianization Of Chinese LawAbstractThe most important features of the Chinese legal system are the combination of morality,etiquette and punishment,which is not only the main feature of the construction in thetraditional Chinese Law,but also the performance of the confucianization of law.Theconfucianization of law absorbed the system of rites and laws in the Western Zhou Dynastyby many Confucian scholars such as Confucius,Mencius,Xunzi,etc.From the Han Dynastythat the combination of rites and laws,with morality as the main punishment to the TangDynasty that the Chinese legal system at peak,the confucianization of law was graduallycompleted.This paper studies the internal structure and historical rationality of ancientChinese Law Confucianism.I think about the rule of virtue and the law of rites and law ofmorality,and analyze advantages and disadvantages of the confucianization of law.I studythe role of legal confucianization in different social stages.In especial,Confucian legal play arole in the construction of law in China.Legal confucianization not only affects the ancientChinese society,but also influences the modern society.Keywords:Law;Confucianism;Rule by virtue;Rule by rites;Humanism
