武汉科技大学本科毕业论文摘要目前,我国面临人口老龄化加速发展,由此带来的一系列社会挑战是,高龄劳动者在人口结构中所占比重持续上升。在这样的背景下,对高龄劳动者的维权工作意义重大,一方面,这是维护他们合法权益的必然要求,另一方面,有助于减轻社会抚养负担,缓解结构性短缺劳动力市场。高龄劳动者的就业权益应得到充分保障,这既是应对当前社会矛盾的现实需要,也是符合我国应对人口老年龄化的长远战略要求,是调节社会关系、维护社会秩序的重要工具。为此我国应从立法保障、制度完善、配套改革三个层面构建对高龄劳动者的就业权益保障体系,一是制定反年龄歧视法,从制度层面明确赋予其平等的劳动主体资格,消除对他们的用工歧视。二是法律保障的系统机制有待建立,建议针对就业歧视投诉的处理程序,完善劳动监察、司法救济、社会支持相结合的救助手段,设立专门保障高龄劳动者就业权益的机构。最后要注重协同保障相关制度,推进退休制度弹性改革,同步完善劳动就业政策和养老保险等社会保障政策,构建系统的高龄劳动者就业权益的法律保障体系,实现劳动用工政策与社会保障制度的有机衔接。关键字:年龄歧视:高龄劳动者;平等就业权武汉科技大学本科毕业论文AbstractAt present,China is experiencing an accelerated aging of its population,which brings aseries of social challenges.One of these is that the proportion of elderly workers in thepopulation structure continues to rise.Against this backdrop,the work of protecting the rightsand interests of elderly workers is of great significance.On the one hand,it is an inevitablerequirement for safeguarding their legitimate rights and interests;on the other hand,it helps toreduce the burden of social support and alleviate the shortage of labor in the market structure.The employment rights and interests of elderly workers should be fully guaranteed.This is notonly a practical need to address current social contradictions,but also in line with China'slong-term strategic requirements for responding to population aging.It is an important tool forregulating social relations and maintaining social order.Therefore,our country should establish an employment rights and benefits guaranteesystem for the elderly workers from three aspects:legislative guarantee,system improvement,and complementary reform.First,an anti-age discrimination law should be formulated toclearly grant them equal labor subject qualifications at the institutional level and eliminateemployment discrimination against them.Second,the system mechanism for legal protectionneeds to be established.It is suggested to improve the handling procedures for complaints ofemployment discrimination,perfect the combination of labor supervision,judicial relief,andsocial support as a means of assistance,and establish a specialized institution to guarantee theemployment rights and interests of the elderly workers.Finally,it is necessary to pay attentionto the coordinated guarantee of related systems.Promote the flexible reform of the retirementsystem,simultaneously improve labor employment policies and social security policies suchas old-age insurance,and build a systematic legal guarantee system for the employment rightsand interests of the elderly workers,achieving the organic connection between laboremployment policies and social security systems.Key words:Age discrimination;Older workers;Equal employment rights武汉科技大学本科毕业论文目录绪论(一)研究背景(二)研究意义(三)研究方法.2(四)国内外研究现状.21.国内文献综述22.国外研究现状3.文献评述4(五)研究创新点一、高龄劳动者平等就业权的概念及理论基础(一)相关概念的界定.51.平等就业权的定义….52.高龄劳动者的定义.6(二)高龄劳动者平等就业权的理论基础61.我国法律体系中的平等就业权的规定.62.国际法视野下的平等就业权73.高龄劳动者的优势与劣势分析14.平等就业权与年龄歧视的边界8(三)劳务关系与劳动关系的界定.二、我国高龄劳动者平等就业权保障的现实困境.9(一)法律保障不足.91.现行法律对年龄歧视规制的缺陷.92.退休再就业者的法律地位不明10(二)就业市场中
