山东师范大学学士学位论文Legal Issues On Tort Liability of Network CopyrightAbstractIn recent years,the global Internet has developed rapidly.At the same time,theprotection problems caused by network copyright infringement also follow.Due to thelate development of various Internet industries in China and the relative stagnation oftraditional copyright legislation,compared with traditional copyright,the object,content and subject of copyright in the network environment have changed to acertain extent.This unprecedented way has changed the speed and frequency ofinformation transmission and reproduction,and caused a series of problems,such asthe communication method of works,the protection and limitation of rights,thedetermination of infringement and the confirmation of tort liability.Therefore,thein-depth study of network copyright infringement liability has extremely importantpractical and theoretical significance.This paper will study the legal provisions of copyright infringement liability ofnetwork works,analyze the distribution of liability and the applicable principles,andprovide theoretical basis for judicial practice.The main contents are as follows:The first part "overview of network works"is a brief introduction of networkworks.The second part "network copyright and network copyright infringement",expounds the concept,characteristics,scope and classification of network copyrightand copyright infringement,and focuses on the legal liability of network copyrightinfringement.The third part "legal provisions and existing problems of copyright infringementliability of network works"introduces the relevant regulations and existing problemsof copyright infringement liability in China,which provides a theoretical basis forimproving laws and regulations.
