摘要目前,我国就业歧视的现象尤为严重,对社会秩序和社会的可持续发展造成了严重的影响。就业关系到人民群众的切身利益,关系改革发展稳定的大局,就业是民生之本。只有通过就业,一个人才能获得收入、安居乐业、实现价值,社会才能不断发展和进步。我们的劳动法明确规定,劳动者在就业中不能因其民族、种族、性别或宗教信仰而受到歧视。同时针对妇女、残疾人、少数民族等群体,结合相关法律及各部门文件,能够在一定程度上保障特殊群体平等就业的权利。然而,由于长期忽视对公民个人权利的保护,以及反就业歧视法律制度的不完善,就业歧视现象在中国蔓延,对整个社会的和谐稳定造成了较为严重的危害。因此抵制就业歧视我们势在必行,保障就业平等有利于促进社会公平。本文着眼于确保众多劳动者的公平就业的权利,通过调查研究和比较分析的方法,对国内外的公平就业规章制度进行了详细的分析和讲解、根据调查研究的成果,试图探索出适合我国基本国情的反就业歧视的法律规制。本文由引言、正文、结语三部分组成,正文部分有四个章节,各章具体内容如下:第一章概述了就业歧视的基础理论。先讲就业和平等就业的概述,以此为突破口,根据就业歧视的理论依据,对就业歧视展开讨论。其次,阐述了就业歧视的判定的标准。最后分析了就业不歧视的标准。第二章关键概述了中国为抵制就业歧视制定的法律制度体系的历史沿革,并阐述了我国保障平等就业的法律制度从解放初期开始到21新世纪,并且介绍了我国就业歧视在当前的状况和就业歧视法律规制的立法方面的问题。第三章通过实践调查的方法,总结了我国存在就业歧视的主要原因,以及我国对特殊群体公平就业的法律保障。第四章提出了我国打击就业歧视现象的建议,通过比较分析的方法,从立法、执法和司法三个层面逐步建立起强有力的反就业歧视法律体系,完善我国的公平就业制度。关键词:就业歧视:反就业歧视:法律规制:平等就业。ABSTRACTAt present,employment discrimination is particularly serious,which has a seriousimpact on social order and sustainable development of society.Employment is related tothe immediate interests of the people and the overall situation of reform,development andstability,and employment is the foundation of people's livelihood.Only throughemployment can a person earn income,live and work happily and realize value,andsociety can continue to develop and progress.Our Labor law clearly stipulates that the employment of workers is not discriminatedbased on different race,race,sex and religious belief.At the same time,women,thedisabled,ethnic minorities and other groups,combined with relevant laws and documentsof various departments,can protect the equal employment rights of special groups to acertain extent.But for a long time,ignoring the protection of individual rights of citizensand the imperfect legal system of anti-employment discrimination,the phenomenon ofemployment discrimination has already existed,and caused a serious danger to theharmony and stability of the whole society.Therefore,it is imperative to resist employment discrimination,and ensuringemployment equality is conducive to promoting social equity.This paper focuses onensuring the fair employment rights of many workers.Through the methods ofinvestigation and comparative analysis,the fair employment rules and regulations at homeand abroad are analyzed and explained in detail.According to the results of theinvestigation and research,it tries to explore the anti-employment discrimination legalregulations suitable for our basic national conditions.This paper consists of introduction,main body and conclusion.The main bodyconsists of four chapters,each of which contains the following contents:The first chapter Outlines the basic theory of employment discrimination.First of all,the introduction of employment and equal employment,as a breakthrough,according to thetheoretical basis of employment discrimination,employment discrimination is discussed.Secondly,it expounds the criterion of employment discrimination.Finally,the standard ofnon-discrimination in employment is analyzed.The second chapter mainly summarizes the historical
