人脸识别的侵权责任认定摘要：人工智能技术背景下，信息技术与生物技术衍生下的人脸识别技术因其非接触性与高效性而成为新一代新型数字产业。人脸识别的侵权责任认定是信息主体的权益遭到侵害以后应当如何救济受害人的损失以及怎样去认定这种侵权的研究，是对个人信息维护和人脸识别规范的追求。侵权行为的特殊性以及法律的滞后性使得自然人个人信息的保护难以完善，进而出现个人信息保护与利用失衡的现状。本文首先运用概念分析法，对人脸识别的侵权的定义进行阐述，之后对侵权行为的特征进行进一步的分析，然后从个人信息的民事法律关系出发，对人脸识别的侵权的一般理论进行思考，并结合《个人信息保护法》的相关规定及司法解释的有关规定，对人脸识别的侵权责任进行理论层面的研究。其次，根据个人信息民事法律关系的主体认定与分类以及侵权构成要件以及免责事由提出人脸识别侵权存在的特殊性以及产生的相关问题。最后，根据提出的相关问题给出完善人脸识别的侵权制度的建议。在人脸识别的侵权中，个体因为网络的便利性而主动选择深度参与，在网络社会的大量互通与交流中，个人信息被不断的收集与利用，侵权行为的特殊性与隐蔽性，呈现出个人财产利益及个人信息的安全隐患，进而增大了相应的救济成本。因此，本文将基于人脸识别侵权行为的法理分析、构成要件、免责事由以及立法建议入手，全面展开人脸识别的侵权责任问题研究。关键词：人脸识别；侵权；责任认定Tort liability determination of face recognitionAbstract:Under the background of artificial intelligence technology,the facerecognition technology derived from information technology and biotechnology hasbecome a new generation of new digital industry because of its non-contact and highefficiency.The identification of tort liability of face recognition is the study of how toremedy the loss of the victim and how to identify the infringement after the rights andinterests of the information subject are infringed.It is the pursuit of personalinformation maintenance and face recognition norms.The particularity of tort and thelag of law make it difficult to perfect the protection of natural person's personalinformation,and then the imbalance between the protection and utilization of personalinformation appears.This paper first uses the concept analysis method,to theinfringement of face recognition Define,after the further analysis of thecharacteristics of infringement,and then start from the civil legal relations,the generaltheory of face recognition of infringement,and combined with the relevant provisionsof the personal information protection law and the relevant provisions of the judicialinterpretation,the theoretical level of tort liability of face recognition research.Secondly,according to the subject identification and classification of the civil legalrelationship of personal information,the constituent elements of infringement and thecauses of exemption,the particularity and related problems of face recognitioninfringement are put forward.Finally,according to the relevant issues raised,we givesuggestions to improve the infringement system of face recognition.In Facerecognition of infringement,individual because of the convenience of the network andchoose depth participation,in network social communication and communication,personal information is constantly collection and utilization,the particularity of tortand concealment,presents the personal property interests and personal informationsecurity hidden danger,thus increases the corresponding relief costs.Therefore,thispaper will be based on the legal analysis of face recognition infringement,constitutiverequirements,exemption reasons and legislative suggestions,to fully develop thestudy of the tort liability of face recognition.Key words:face recognition;infringement;liability determination目录序言.一、人脸识别的侵权责任认定相关概述......
