论环境污染防治中公民环境信息知情权的保障

论环境污染防治中公民环境信息知情权的保障摘要在各个时代出现的环境问题并不相同，但是这些时代所存在的问题都表现出相同的特征，也就是由于人类活动范围的持续扩张、活动类型的多样化使得环境污染更加严重。环境问题的不断显现使得人们从之前重视物质需要的满足逐步转化为人类发展对环境带来的污染问题。从20世纪60年代开始，全球各个国家都逐渐意识到环境建设在国家经济水平提高以及社会发展方面发挥的关键价值，并采取一系列保障方法来使得环境不受侵害，但是大部分国家使用的方法都只是凭借政府力量但是没能关注群众的价值和效果。由于全球各个国家的民主水平不断上涨，更多的国家开始认识到在政策实施和环境管理方面只运用政府力量很难从本质上化解环境污染。群众参与和政府管控之间构成良好的互动制度，再加上环境和群众有着十分紧密的联系，因此在治理环境时发挥群众力量非常关键。考虑到如今环境问题逐渐严峻，需要整合所有力量来发挥最大治理效果，而群众就是最关键的力量。群众在环境治理方面积极参与时需要构建“环境信息知情权”，只有这样才能让群众能够在所了解环境信息的基础上积极参与环境决策，以此来帮助环境问题更好地化解。如今全球不同政府和环境领域研究人员更加关注这个问题，也开始在立法制度方面设立详细的环境治理方案。中国发展成为全球大国之一也面临着环境问题，开始设计相应的法律制度但是还不够健全。本论文也是在该研究意义的基础上来深入分析该问题，以此来在理论研究过程中可以帮助我国环境立法制度更加完善。关键词：环境信息知情权，环境信息公开制度On the Guarantee of Citizens'Right to KnowEnvironmental Information in the Prevention andControl of Environmental Pol lutionAbstractThe environmental problems that have emerged in each era are not the same,butthey all have the same characteristics,namely,the continuous expansion of humanactivities and the diversification of the types of activities that have madeenvironmental pollution more serious.The emergence of environmental problems hasled to a shift in emphasis from the satisfaction of material needs to the pollution of theenvironment caused by human development.Since the 1960s,countries all over the world have been aware of the key value ofthe environment in the economic and social development of their countries and haveadopted a series of measures to protect the environment,but most of them have usedonly the power of the government but have failed to focus on the value andeffectiveness of the people.As the level of democracy increases in countries aroundthe world,more countries are beginning to realize that it is difficult to use onlygovernment power in policy implementation and environmental management toessentially solve environmental pollution.A good system of interaction between massparticipation and government control,coupled with the strong connection between theenvironment and the people,makes it crucial to use the power of the people inenvironmental management.Considering that environmental problems are becomingmore and more serious today,it is necessary to integrate all the forces to maximize theeffect of governance,and the masses are the most crucial force.The right to knowenvironmental information is needed for the public to actively participate inenvironmental governance,so that they can actively participate in environmentaldecision-making based on the environmental information they know,and thus help tosolve environmental problems better.Different governments and environmentalresearchers around the world are now paying more attention to this issue and arebeginning to set up detailed environmental governance programs in the legislativesystem.China,which has developed into one of the major global powers,is alsofacing environmental problems and has started to design a corresponding legal systembut it is not yet sound enough.This thesis is also based on the significance of thisresearch to analyz
