驻港国安公署直接管辖权的法理基础与程序控制

National Security Agency in Hong KongAbstractOn June 30,2020,the Hong Kong National Security Law was passed and promulgatedby the Standing Committee of the National People's Congress.Chapter V established theNational Security Office in Hong Kong and gave it direct jurisdiction over three types ofspecial crimes that endanger national security.Different from Hong Kong's local lawenforcement agencies'jurisdiction over general cases of endangering national security,thedirect jurisdiction of the National Security Agency in Hong Kong belongs to the category ofnational security and should be enacted at the central level.Analyzed from the perspective oflegal basis,the "one country,two systems"system,the central comprehensive governancepower,the constitution,and the Hong Kong Basic Law can all provide strong support for it;from the perspective of procedural control,the jurisdiction is limited from the subject of theproposal to the scope of exercise Sex and restraint,and will not affect the judicialindependence of Hong Kong.It can be seen that the establishment of the direct jurisdiction ofthe National Security Agency in Hong Kong is both reasonable and legal,and it is indeed apowerful move for the central government to safeguard the national security of the HongKong Special Administrative Region.Keywords:Hong Kong National Security Law,Hong Kong Basic Law,National SecurityAgency in Hong Kong,Direct jurisdiction目录一绪论(一)选题意义…(二)国内外研究现状....1
