论城市房屋拆迁中的弱势群体保护摘要城市化的程度和速度是衡量一个国家现代化程度的重要指标。近年来，随着社会的发展和时代的进步，我国城市化的步伐不断加快，城市建设和发展的速度和程度也日新月异。当前，我国城市的建设、改造及扩展的基本前提在城市房屋拆迁规模日益扩大，由此带来侵害城市弱势群体合法权益问题也愈发凸现，由于弱势群体在拆迁过程中，部分人员权利得不到有效保障及相应的法律援助，继而产生情绪激动引发与拆迁单位、项目开发公司和有关政府部门之间的矛盾冲突，使得弱势群体的地位进一步边缘化，更加弱势化，进而影响社会安定稳定、和谐发展。因此，如何妥善处理和解决城市建设中各种力量与弱势群体利益之间的关系，成为我们亟需面对的问题。关键词：城市拆迁：弱势群体：利益保护1AbstractThe degree and speed of urbanization are important indicators of thedegree of modernization of a country.In recent years,with the developmentof society and the progress of The Times,the pace of urbanization in Chinais constantly accelerating,and the speed and degree of urban constructionand development are also changing with each passing day.At present,the basic premise of urban construction,transformationand expansion in urban housing demolition,thus the legitimate rights andinterests of urban vulnerable groups in the process of demolition,somepersonnel rights are not effectively guaranteed and corresponding legalaid,and emotional and demolition units,project development company andrelevant government departments,make the vulnerable groups furthermarginalized,more vulnerable,and affect the social stability,stabilityand harmonious development.Therefore,how to properly handle and solvethe relationship between various forces in urban construction and theinterests of vulnerable groups has become a problem that we urgently needto face.At present,the problems existing in the process of urban housingdemolition in China are mainly manifested in:the demolition system isnot perfect,the role of government departments in the demolition,theineffective supervision of administrative departments,and the coverageof housing demolition is not wide.Laws and regulations are weak,and the compensation standard fordemolition is low.These problems directly damage the rights and interestsof the vulnerable groups in the demolition,leading to the increasednumber of petitions,and even self-immolation,jumping and otherbuildings,aggravate social contradictions,disturb social order,anddestroy social stability.To solve the chaos of urban demolition,China is far from enough torely solely on the government's administrative orders alone,which is notenough to completely solve the problem.The rights of the vulnerable groupsshould be fundamentally guaranteed and defended.First of all,the functional departments of the Chinese governmentshould clarify the legislative concept,revise and improve the currentlaws and regulations,so that the judicial procedures can intervene inthe urban demolition chaos in a timely and effective manner.Since the reform and opening up,the protection of vulnerable groupshas attracted wide attention.From protecting the interests of vulnerablegroups,this paper studies the lack of urban housing demolitionlegislation in China,and puts forward corresponding suggestions.This paper preliminarily discusses the social vulnerable groups andtheir rights protection from the perspective of existing laws andregulations.Key words:urban demoliti
