网络交易中消费者权益保护的法律规制研究摘要新时代发展迅速,网络交易在快节奏的生活模式下展现了活力,成为主流的消费模式。跨时空的网络交易方便、快捷,但是如何完成自己真正想要的商品和服务交易也成为一项难题。经营者将提供的商品或服务进行描述并展示在互联网上,消费者被动的接受信息,在这个过程中可能会导致的信息偏差将会很大程度的影响网络交易,消费者的合法权益难以得到应有的保护。此外,信息泄漏、网络诈骗等问题也层出不穷,我们需要通过反思和分析网络交易中对消费者权益保护的法律效果,思考如何在复杂的网络交易中适应实践发展需求,更好的维护消费者合法权益不受侵害。本研究旨在通过分析研究网络交易对于消费者权益保护发展过程中的现实必要性,通过对消费者知悉真情权、安全保障权、公平交易权、受害求偿权四个方面的解读,梳理并分析我国关于网络交易中的法律制度及缺陷。与域外国家在相关制度方面进行对比、思考与借鉴,结合我国实际提出建议:完善网络消费者信息披露制度、加强对消费者个人信息安全的保护、规范格式合同制度、完善我国的撤回权制度、增加网络消费者受害求偿的途径、规范网络交易平台和监管部门的相关责任等以推动我国网络交易中消费者权益保护的法律规制更好的发展完善。关键词:网络交易网络消费者消费者权益法律保护AbstractWith the rapid development of the new era,online transactions have shown vitality in thefast-paced life mode and become the mainstream consumption model.Network transactionsacross time and space are convenient and fast,but how to complete the transaction of goodsand services you really want has also become a problem.Operators will provide goods orservices to describe and display on the Internet,consumers passively accept information,inthis process may lead to information deviation will greatly affect network transactions,consumers'legitimate rights and interests are difficult to get due protection.In addition,information leakage,online fraud and other problems are also emerging one after another,weneed to reflect and analyze the legal effect of consumer rights protection in online transactions,think about how to adapt to the needs of practical development in complex online transactions,and better protect the legitimate rights and interests of consumers from infringement.Thisresearch aims to sort out and analyze the legal system and defects in online transactions inChina by analyzing and studying the practical necessity of online transactions in thedevelopment of consumer rights and interests,and through the interpretation of consumers'right to know the truth,security guarantee,fair trade and victimization claim.Compare,thinkand learn from relevant systems with countries outside the region,and make suggestionsbased on China's actual conditions:improve the online consumer information disclosuresystem,strengthen the protection of consumers'personal information security,standardize thestandard contract system,improve China's right of withdrawal system,increase the channelsfor online consumers'victimization claims,standardize the relevant responsibilities of onlinetrading platforms and regulatory authorities,etc.so as to promote the better development andimprovement of the legal regulation of consumer rights and interests protection in China'sonline transactions.Key words:Online transactions Online consumersConsumes'interestslegalIVprotection
